These Terms of Use ("Terms") govern your access to and use of the Kildavero platform and website at kildavero.com, operated by Kildavero Ltd, 12 Merrion Square, Dublin 2, D02 HW37, Ireland ("Kildavero", "we", "us"). By submitting an access request or using any part of the platform, you agree to these Terms in full.
1. The platform
Kildavero is an intelligent AI platform that provides data analysis, structured insights, workflow automation and a personalised information dashboard. The platform is intended as a decision-support tool. It does not make decisions on your behalf and does not guarantee any particular outcome from your use of its features.
2. Access
Access to the Kildavero platform is granted through an access-request process described on the platform website. Kildavero reserves the right to approve or decline any access request at its discretion. Access is personal, non-transferable and subject to continued compliance with these Terms.
3. User responsibilities
As a user of the Kildavero platform, you agree to:
- Provide accurate, up-to-date information in your access request and any subsequent communications with the support team.
- Use the platform only for lawful purposes and in accordance with these Terms.
- Not attempt to circumvent security controls, disrupt platform functionality or access parts of the system you are not authorised to use.
- Not share your access credentials with any third party.
- Not use the platform to transmit unlawful, harmful, defamatory or otherwise objectionable content.
4. Platform availability
Kildavero aims to maintain a reliable and accessible service, but does not guarantee uninterrupted availability. The platform may be temporarily unavailable due to maintenance, updates or factors outside our control. We will communicate planned downtime where reasonably practicable.
5. Intellectual property
All content, design, software and materials made available through the Kildavero platform remain the intellectual property of Kildavero Ltd unless otherwise stated. You may not reproduce, redistribute or create derivative works from platform content without written permission.
6. Data and privacy
Your use of the platform is also governed by our Privacy Policy, which forms part of these Terms. By using the platform, you confirm that you have read and understood how we collect, use and protect your personal data.
7. Limitations of liability
To the fullest extent permitted by applicable law, Kildavero Ltd shall not be liable for any indirect, incidental, consequential or special loss or damage arising from your use of or inability to use the platform. Kildavero's total liability for any claim arising out of these Terms shall not exceed the amount, if any, paid by you for access to the platform in the preceding 12 months.
8. No warranties
The Kildavero platform is provided on an "as is" and "as available" basis. We do not warrant that the platform will be error-free, that data analysis outputs will be accurate in all circumstances, or that use of the platform will produce any particular result. The platform is a decision-support tool, not a substitute for professional judgement.
9. Termination
Kildavero may suspend or terminate your access to the platform if you breach these Terms or if we reasonably believe continued access poses a risk to the platform or other users. You may request termination of your account at any time by contacting [email protected].
10. Governing law
These Terms are governed by the laws of Ireland. Any dispute arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Ireland.
11. Changes to these Terms
Kildavero may update these Terms from time to time. The most recent version will always be available at kildavero.com/terms.html. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
